日本国の対韓十か条の要求その1-竹島からの撤退:The Ten Demands to South Korea Part1 Withdrawal from Takeshima

 日本国の対韓十か条の要求の第1の要求は、竹島からの撤退です。

 1952年1月18日、韓国政府は李承晩ラインを一方的に設定し、1953年4月20日には、江戸時代に幕府が運営し、国際法に基づいて1905年に正式に日本国の島根県編入した竹島に独島義勇守備隊を上陸させます。そして同年7月27日には、韓国政府は竹島の領有を宣言するのです。日本国は、この時期、新たに制定された日本国憲法の第9条の制約により自衛隊が未だ発足しておらず、竹島を防衛することができませんでした。この行為は、武力による現状の変更に他ならず、韓国が、日本国の領土の一部を不法占拠する状態が今日まで続いています。日本国政府は、国際司法裁判所での司法解決を提案していますが、韓国政府は、日本国の申し出を拒否し、頑なに応じようとはしません。韓国政府が、竹島問題の司法解決を回避するのは、自国には、竹島領有の法的、並びに、歴史的根拠がないことを知っているからではないでしょうか?日本国には、竹島からの撤退を韓国に求める正当な理由があります。最低限、韓国政府は、ICJでの解決を認めるべきなのです。

English: Withdrawal from Takeshima

On April 20, 1953, the government of South Korea dispatched armed Military volunteers to the Takeshima Island (Takeshima, Leancourt Rocks, Dokdo) and declared the possession of the islets on July 27, after the declaration of the establishment of so-called ‘the Syngman Rhee Line of 1952,’ an illegal boundary line between Japan and South Korea on the Sea of Japan.

Historically, the government of Japan had incorporated Takeshima into Shimane Prefecture officially in 1905 under the rule of the international law, following the fact that Takeshima had ever remained under the control of the Tokugawa Shogunate as a part of the Oki Province since 1696, when the government of Tokugawa Shogunate prohibited Japanese people from crossing over to the Ulleungdo Island. In those days, Ulleungdo was called “Takeshima,”where was also recognized to be within the Japanese territory: the present Takeshima, on the other hand, called “Matushima” in Japanese.

When Takeshima was occupied by South Korea in 1953, Japan could not defense Takeshima by any Japanese military force, because Article 9 of the newly established Constitution of Japan restricts possession of them (the Japanese Self Defense Force was founded soon after the occupation of Takeshima by South Korea). South Korean’s illegal occupation of Takeshima was none other than an aggression, so to speak ‘unilateral change of the status quo by force of arms.’

While the government of Japan has frequently offered the suggestion to appeal to the International Court of Justice jointly, the government of South Korea has rejected this peaceful means for the settlement of the Takeshima problem to this day. Why does the government of South Korea escape from the fair judgment by the ICJ? Japan has the rightful grounds to demand to South Korea for the withdrawal of their occupation forces from Takeshima. The government of South Korea should at least accept the Japanese proposal of the settlement by legal measures.
