日本国の対韓十か条の要求の第５番目の要求は、韓国企業の不正行為に対する取り締まり強化です。

2012年４月25日、日本国の鉄鋼会社である新日鉄住金は、韓国企業のポスコを相手取り、不正競争防止法違反で1000億円の損害賠償を求める訴訟を東京地方裁判所に起こしました。2014年３月13日には、東芝もまた、半導体メモリの研究データを韓国のSKハイニックスに流した元社員が逮捕されたことを受けて、同社の提訴に踏み切りました。これらの事件は氷山の一角とされ、日本企業に対する韓国企業による技術盗用は、日本企業にダメージを与えています。莫大な研究費を投じて開発した先端技術が、投資の回収を待つまでもなく、ただ同然で韓国の企業の手に渡るのですから。こうした侵害行為は、日本企業の技術管理体制の不備にも問題がありますが、盗用してまで技術導入を図ろうとする韓国企業のモラル欠如に主たる原因があります。韓国企業による知的財産権の侵害によって自国企業が損害を被っているのですから、日本国政府には、韓国政府に対して、自国企業の不正行為の取り締まりを強化すべく要求する正当な権利があります。

On April 25, 2012, a Japanese steel company, Nippon Steel & Sumitomo Metal Corporation, raised a lawsuit to the Tokyo district court, claiming damages of approximately10million dollars based on the Unfair Competition Prevention Law, against a Korean steel company, Posco, for theft of advanced technology secret. Another similar lawsuit was instituted by a Japanese engineering and electronics conglomerate corporation, Toshiba Corporation, against a Korean memory semiconductor supplier, SK Hynix, on March 13, 2014.
These cases are indeed ‘tip of iceberg.’ While Japanese companies have invested an enormous amount of money in the field of the research and development of technology with costing long-term continuous effort, Korean companies easily obtain them with far less expenditures by unfair means.
This problem is mainly caused by moral deficiency of Korean enterprises, which do not hesitate to outflank their rivals by stealing intellectual properties and industrial secrets form them. On the grounds of the fact that a considerable number of Japanese companies as well as those of other foreign countries, for example Apple Inc., has suffered damages from Korean’s illegal acts, such as ‘industrial espionage,’ the government of Japan has sufficient reason to demand to the government of South Korea to regulate and supervise over dishonest behaviors of their companies strictly.
